Privacy Policy.
This policy explains what information GrowthKit AI collects, how we use it, and the choices you have. We've tried to write it in plain language. The defined terms and the limits of our liability still apply.
Who we are.
In this policy, "GrowthKit AI", "we", "us", and "our" refer to GrowthKit AI and its affiliates. GrowthKit AI is headquartered in the United Kingdom and provides software-as-a-service to customers worldwide, with a particular focus on the United Kingdom and the United States. "You" means any individual or entity that visits our website, joins our waitlist, communicates with us, or otherwise uses our services (the "Services").
GrowthKit AI acts as the data controller for personal data collected through the Services unless otherwise specified.
What this policy covers.
This policy applies to personal information we collect through our website, waitlist forms, email correspondence, and any pre-release or beta features we may offer. It does not apply to third-party websites, products, or services, even if they link to or from ours.
By accessing or using the Services, you acknowledge that you have read and understood this policy. If you do not agree with it, please do not use the Services.
Information we collect.
Information you provide
- Contact details — your name, email address, company name, role, and any other details you submit through the waitlist, contact forms, or email.
- Communications — the contents of messages you send us, including questions, feedback, and any attachments.
- Pilot & beta data — if you participate in a pilot or private beta, information about your company, growth stage, channels, and goals as you choose to share it.
Information collected automatically
- Device & usage data — IP address, browser type, operating system, referring URLs, pages viewed, links clicked, and timestamps.
- Cookies & similar technologies — see Section 07.
Information from third parties
We may receive limited information about you from analytics providers, hosting providers, and publicly available sources (for example, your professional profile if you contact us through LinkedIn).
How we use information.
We use the information we collect to:
- Operate, maintain, and improve the Services;
- Respond to inquiries, manage waitlist access, and deliver pilot communications;
- Understand how the Services are used and develop new features;
- Detect, prevent, and respond to fraud, abuse, security, or technical issues;
- Comply with legal obligations and enforce our terms; and
- Send you transactional or, where permitted, marketing communications (you can opt out of marketing at any time).
We do not sell your personal information. We do not use your personal information to train third-party large language models without your consent.
Legal basis (UK/EEA).
If you are in the United Kingdom or European Economic Area, we process personal data under one or more of the following legal bases: (a) your consent; (b) performance of a contract with you; (c) compliance with a legal obligation; or (d) our legitimate interests in operating, securing, and improving the Services, where those interests are not overridden by your rights.
International transfers.
We may process and store information in countries other than the one you live in, including the United States and the United Kingdom. Where required, we use appropriate safeguards (such as Standard Contractual Clauses or the UK International Data Transfer Addendum) to protect personal data when it is transferred internationally.
How long we keep data.
We retain personal information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need it, we will delete or anonymize it in line with our internal retention schedules.
How we protect data.
We use administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or electronic storage is one hundred percent secure, and we cannot guarantee absolute security. You use the Services at your own risk.
Your rights.
Depending on where you live, you may have the right to access, correct, delete, restrict, or object to our processing of your personal data, the right to data portability, and the right to withdraw consent. You may also have the right to lodge a complaint with a supervisory authority — for example, the Information Commissioner's Office in the UK.
To exercise any of these rights, contact us at info@growthkitai.com. We may need to verify your identity before responding.
Children's privacy.
The Services are not directed to, and we do not knowingly collect personal information from, children under 16. If you believe a child has provided us with personal information, please contact us so we can delete it.
Third-party links.
The Services may contain links to third-party websites and services. We are not responsible for the privacy practices or content of those third parties, and this policy does not apply to them. Please review their policies before sharing personal information.
Disclaimers.
THE SERVICES AND ALL CONTENT, INFORMATION, AND MATERIALS PROVIDED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GROWTHKIT AI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of viruses or other harmful components, nor do we warrant that any information obtained through the Services is accurate, complete, or reliable. Any reliance you place on such information is strictly at your own risk.
Limitation of liability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GROWTHKIT AI, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES, EVEN IF GROWTHKIT AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL THE AGGREGATE LIABILITY OF GROWTHKIT AI ARISING OUT OF OR RELATING TO THIS POLICY OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO GROWTHKIT AI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in this policy excludes or limits liability that cannot be excluded or limited under applicable law (including, where applicable, liability for death or personal injury caused by negligence or for fraud).
Indemnification.
You agree to defend, indemnify, and hold harmless GrowthKit AI and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (i) your access to or use of the Services, (ii) your violation of this policy, or (iii) your violation of any rights of another party or any applicable law.
Changes to this policy.
We may update this policy from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, take reasonable steps to notify you (for example, by email or a notice on the Services). Your continued use of the Services after changes take effect constitutes acceptance of the updated policy.
Governing law.
This policy is governed by the laws of England and Wales, without regard to its conflict-of-laws principles. The courts of England and Wales have exclusive jurisdiction over any disputes arising out of or relating to this policy, and you consent to the personal jurisdiction of those courts. Where local mandatory law gives you stronger rights as a consumer — including, for users in the United States, rights available under applicable state law — those rights are not affected.
